COST ESTIMATE & PAYMENTS
1. A scanned signed cost estimate (CE) must be emailed to DESIGNHUB upon approval.
2. The CE and final billing may vary, depending on client’s additional changes or in excess of the number of allowed revisions.
3. Additional percentage tax applies to CUSTOMERS in the Philippines.
REVISION SUBMISSION & ADDED COST
1. Additional 17.65% Agency Service Fee (ASF) for suppliers sourced through DESIGNHUB.
2. Initial design includes three (3) studies. Additional cost for additional studies.
3. CUSTOMER can initiate revision on a design up to three (3) times. Succeeding revisions or editing is billed per man-hour.
4. Design adaptation is 30-70% from the original concept fee plus additional editing fees.
5. Text and information should be submitted in soft copy. Additional fees for encoding and photo scanning.
5. Studies and revisions are submitted on-line in PDF format. Hard copy or mock-up maybe requested and sent to CUSTOMER through courier with corresponding fees.
6. Additional editing fee applies to special illustration, interpolation or digital drawings that requires longer hours to develop. This includes (A) photographic images (B) interpolation of an image from the CUSTOMER, internet or printed material (C) sketch, drawing and other form of complicated illustrations (D) logo or icon.
7. Digital proof’s color may vary depending on CUSTOMER’S monitor and hardware. Proof as seen at the computer monitor may differ on a computer printed material. Likewise, a computer printed material may differ from a finished printed material. A pantone guide will be the color reference unless specified by the CUSTOMER.
8. Final artwork (FA) shall be submitted to CUSTOMER in PC Windows platform.
INTELLECTUAL PROPERTY
1. DESIGNHUB owns the intellectual and copyrights of all designs submitted, unless agreed in writing that the rights solely belongs to the CUSTOMER.
2. CUSTOMER agrees not to plagiarized in part or in full, or use the designs submitted as peg for other projects.
3. Unapproved studies must be returned to DESIGNHUB, the CUSTOMER is strictly prohibited from reusing it in any other form.
4. If CUSTOMER publishes an unauthorized study or concept from this project, the CUSTOMER shall be liable under the following laws: Article 61 (United States) of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs), Copyright infringement, Online Copyright Infringement Liability Limitation Act (OCILLA) and / or Republic Act No. 8293, for the Philippine Intellectual Property Code of the Philippines.
CUSTOMER SERVICE & WARRANTY
1. DESIGNHUB services is 100% online, if CUSTOMER requires a personal appearance, an additional fee per diem and transportation cost will be shouldered by the CUSTOMER, added to the final billing.
2. Supervision fees applies to any pre or postproduction such as printing, creative direction during photo sessions or any form of creative supervision that will require any personnel of DESIGNHUB to be physically present.
3. DESIGNHUB will resolve technical issues regarding the artwork limited to (A) Minor color & shade adjustments (B) Minor text corrections (C) Platform migration will
4. DESIGNHUB will receive in good faith all illustrations, photos and information supplied by CUSTOMER. The CUSTOMER will solely be responsible should there be any copyright violations.
DURATION, DEFERMENT, EXPIRATION, CANCELLATION & FINAL APPROVAL
1. Project must be completed within a period of 30 days to 6 months. If CUSTOMER fails to submit revision or approve studies within this period, the project will expire and payments made will not be refunded. No editable artwork will be released, unless the total bill is settled. If CUSTOMER wishes to pursue the project, a revised cost estimate shall be agreed upon.
2. The CUSTOMER has the right to cancel the project any time. Payments will not be refunded and no materials or editable artwork will be released or shall be used by CUSTOMER in part or in full unless the total bill is settled.
3. The client should give a final approval or conforme to all materials or artwork prior to release. Any revision thereafter will be billed per manhour.
FORCE MAJEURE
1. If either party is temporarily unable, by reason of Force Majeure, to meet any of its obligations under this contract, and if such party gives the other party a written notice of the event within seven (7) days after occurrence, such obligations of the party shall be suspended for as long as the inability continues or within a period of 365 days.
CONFIDENTIALITY:
1. It shall be understood that DESIGNHUB shall keep in utmost confidentiality all data and information, obtained verbally or in writing, relative to the Project of the CUSTOMER. Likewise, studies and strategy shared and submitted by DESIGNHUB will not be transmitted by the CUSTOMER to other entities except the Final Artwork. |
